Please read these Terms and Conditions (“Terms”) carefully before using the website located at https://www.pratibhapharma.com/ (the “Service”) operated by Pratibha Pharma, a licensed pharmacy located at 1015-1016, 10th Floor, J R Tower, Near Mokshdham, Nagpur 440024, Maharashtra, India (“Company,” “We,” “Us,” or “Our”).
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.
1. Interpretation and Definitions
Capitalized terms used in these Terms have the meanings defined below, whether appearing in singular or plural form:
- Account means a unique account created for You to access our Service.
- Company refers to Pratibha Pharma.
- Goods or Products refers to the medicines and pharmaceutical items offered for sale through the Service.
- Order means a request by You to purchase Goods from Us.
- Service refers to the Website.
- You means the individual accessing or using the Service.
2. Nature of the Service
Pratibha Pharma is a licensed pharmacy operating in India. We sell medicines and pharmaceutical products through the Service, both within India and via export to customers in other countries, subject to applicable law.
3. Eligibility and Prescription Requirement
3.1. Prescription requirement. Many of the medicines available through the Service require a valid prescription from a licensed medical practitioner. You must upload or otherwise provide a valid, legible, and current prescription for any such Order before We will process it. Orders for prescription medicines placed without a valid prescription will not be fulfilled.
3.2. Age and eligibility verification. We may require You to provide proof of age or other eligibility information for certain Products. By placing an Order, You represent and warrant that all information You provide, including Your age and any prescription details, is true, accurate, and belongs to the person for whom the medicine is intended.
3.3. Right to refuse or cancel. We reserve the right, at Our sole discretion, to refuse to process, or to cancel, any Order that:
- Is not accompanied by a valid prescription where one is required;
- Fails age verification or other eligibility requirements;
- Contains information We reasonably believe to be false, incomplete, or fraudulent;
- We are unable to fulfill due to regulatory, licensing, export, or supply restrictions; or
- Otherwise fails to meet any requirement of applicable pharmaceutical or export law.
We will make reasonable efforts to notify You if an Order is refused or cancelled for these reasons.
4. Product Information, Images, and Generic Substitution
4.1. Images are for reference only. Product images displayed on the Service are for illustrative and reference purposes only. Actual product packaging, labelling, appearance, size, and color may vary from the images shown, including due to differences between manufacturing batches, regional packaging, or supplier.
4.2. Generic substitution. Where permitted by applicable law and pharmaceutical practice, We may fulfill Your Order using a generic equivalent of the medicine ordered, containing the same active ingredient(s), strength, and dosage form, in place of a specific brand shown on the Service. By placing an Order, You consent to such substitution unless You have clearly indicated otherwise and We have agreed to fulfill Your Order as specified.
4.3. Descriptions of Products are provided for general informational purposes and do not constitute medical advice. Always consult a qualified medical practitioner regarding the suitability, dosage, and use of any medicine.
5. Orders, Payment, and Cancellation
5.1. Placing Orders. When You place an Order, You are making an offer to purchase the Goods, which We may accept or decline at Our discretion, including for the reasons set out in Section 3.3.
5.2. Payment methods. We accept payment via PayPal (manual transfer), Bank Transfer, and USDT (cryptocurrency transfer). You are responsible for ensuring payment is made correctly and in full using Your chosen method. Orders will not be processed until payment is confirmed.
5.3. Cancellation by You. You may cancel Your Order only before it has been processed. Once an Order has been processed (including but not limited to prescription verification, picking, packing, or dispatch), it cannot be cancelled.
5.4. Non-refundable. All Orders are non-refundable once payment has been made and the Order has been accepted, except where required by applicable law (for example, where We are unable to fulfill Your Order due to a cancellation on Our part under Section 3.3, or where a Product is confirmed to be defective or incorrectly supplied due to Our error).
5.5. Cancellations by Us. Where We cancel an Order under Section 3.3 or due to unavailability of stock, We will inform You and, where payment has already been made and the Order not yet processed, will address the payment in accordance with applicable law.
6. Shipping and Export
6.1. We ship Orders within India and export to customers internationally, subject to compliance with applicable customs, export control, and pharmaceutical import/export laws of both India and the destination country.
6.2. You are responsible for ensuring that the Products You order may be lawfully imported into Your destination country. We are not responsible for Orders seized, delayed, or refused entry by customs or other authorities in the destination country, and such Orders remain subject to Section 5.4 (non-refundable).
6.3. Delivery timeframes are estimates only and are not guaranteed.
7. Intellectual Property and Trademarks
7.1. Unless otherwise stated, the content, layout, and design of the Service are owned by or licensed to the Company.
7.2. Third-party trademarks. Any product names, brand names, logos, or trademarks displayed on the Service belong to their respective owners. We do not claim ownership of any such trademarks. They are used solely for the purpose of identifying and describing the Products available through the Service (nominative/informational use), in accordance with their use in the public domain. Use of these trademarks does not imply any affiliation with, sponsorship by, or endorsement from the respective trademark owners.

8. Disclaimers
8.1. The Service and Products are provided on an “as is” and “as available” basis. Medicines are provided subject to their manufacturer’s specifications, and We make no warranty regarding the efficacy or suitability of any medicine for Your particular condition.
8.2. Nothing on the Service constitutes medical advice. You should consult a licensed medical practitioner before using any medicine ordered through the Service.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from Your use of the Service or Products purchased through it, except where such liability cannot be excluded under applicable law (including laws applicable to defective or unsafe pharmaceutical products).
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles, without prejudice to any mandatory consumer protection laws applicable in Your country of residence for cross-border/export Orders.
11. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. We will indicate the “Last updated” date at the top of these Terms when changes are made. Your continued use of the Service after any such changes constitutes Your acceptance of the new Terms.
